Terms of Service

1. Acceptance of Terms

By accessing or using AffirmID's services, including our mobile application, web dashboard, and API ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and AffirmID, Inc. ("AffirmID," "we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Services constitutes acceptance of any changes.

2. Description of Services

AffirmID provides multi-factor authentication services, including but not limited to:

• Push notification-based authentication
• Time-based one-time password (TOTP) generation
• Biometric authentication verification
• Device attestation services
• Identity verification and selective disclosure
• API access for third-party integrations

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.

3. Account Registration

To use our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You must be at least 18 years old to create an account. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Transmit malicious code or conduct security attacks
• Use the Services for fraudulent purposes
• Resell or redistribute the Services without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscription and Payments

Certain features of the Services require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless canceled before the renewal date
• Price changes will be communicated at least 30 days in advance
• Refunds are provided in accordance with our refund policy

All payments are processed securely through Stripe. We do not store your full payment card information on our servers.

6. API Usage

If you use our API, you additionally agree to:

• Comply with our API documentation and rate limits
• Keep your API keys confidential and secure
• Not use the API to create competing products
• Properly attribute AffirmID where required

We may revoke API access for violations of these terms or abuse of the API.

7. Intellectual Property

All content, features, and functionality of the Services are owned by AffirmID and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

You retain ownership of any data you submit to the Services, and grant us a limited license to use that data solely to provide the Services to you.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

While we strive for 99.99% uptime and implement robust security measures, you acknowledge that no authentication system can guarantee absolute security.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFFIRMID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AffirmID and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
